Software Switch to tunr off Touch

how is there no Software toggle to disable touch??? my touch switch on intous pro does not work anymore therefore the touch function is always enabled. also there is the annoying issue of accidently enabling it when packing/unpacking the tablet. Is this some kind of planned obstolecese? do I need to report the issue to consumer protection? all buttons can be enabled/disabled via software except the touch button rendering my 300 dollar Tablet useless.
